Fullerton v. Golden Flake

What is the case about?
On May 4, 2017, we filed Fullerton v. Golden Flake Snack Foods, No. 3:17-cv-296 (N.D. Florida), a collective action alleging that Defendant improperly classified its route sales employees under the outside sales exemption and denied them overtime compensation.

What does the settlement provide?
The parties reached a settlement of the case and filed a Motion for Approval on March 8, 2019, which can be obtained here. Motion for Approval. On March 11, 2019, the Court granted final approval of the settlement.

Golden Flake's Settlement Payment of $1,700,000, after deductions, will be divided proportionally into Individual Payments for which the Representative Plaintiff, Existing Opt-In Party Plaintiffs, Eligible Settlement Participants, and Class Members will be eligible.

Is the settlement fair and reasonable?
Employees who participate in the Settlement will receive approximately 80.14% of their alleged overtime damages over the 3-year limitations period, and 135.68% of their alleged overtime damages over the 2-year limitations period, before deductions, assuming employees worked an average of 48.5 hours per week.

Am I part of the class?
The class consists of 660 current and former route sales employees of Golden Flake.
